Terms of Service

These terms apply to www.holyfoolco.com and to our tickets and giving site, give.holyfoolco.com, including the guest and donor portal. By using the sites, buying a ticket or making a gift, you agree to them. "Holy Fool", "we" and "us" mean Holy Fool, a Colorado nonprofit corporation, tax-exempt under section 501(c)(3) of the Internal Revenue Code (EIN 33-3015829). Our Privacy Policy explains how we handle personal information and is part of these terms.
1. Tickets
What you get. The event page states the date, the venue, the price and what a ticket includes. Some ticket types cover more than one seat, such as a table. Whatever you buy, you receive one ticket per seat, each with its own code.
Your code is your ticket. Each code admits one person once. It is also the key to that ticket in the portal, so keep it private and share it only with the person who will use the seat. If you share a code and someone else uses it, we cannot admit a second person on the same code.
Naming guests at giving events. You can name a guest for each seat at a giving event in the portal until the deadline shown on the event page. The guest receives their own code by email, and the previous code for that seat stops working. Name only people who have agreed to let you give us their name, their email address and any note the event asks for.
No refunds. Ticket purchases are final. We do not refund tickets, including when you cannot attend, and the checkout asks you to confirm this before you pay. If you cannot come, name someone else as the guest for your seat.
If we change or cancel an event. We may change an event's date, venue or program, and we will email ticket holders when we do. If we cancel an event and do not reschedule it, we will offer ticket holders the choice of a refund or of treating the payment as a gift to Holy Fool.
At the event. Entry is subject to the venue's rules, to any age requirement stated on the event page and to our reasonable directions. We may refuse entry, or ask someone to leave, for behavior that endangers or disrupts others, without a refund. We may photograph or record our events for Holy Fool's own communications; tell us at the door if you prefer not to appear.
Payment problems. We may cancel tickets bought with a payment that fails, is reversed, or was not authorized by the cardholder.
2. Gifts
One-time gifts. A gift is a contribution to Holy Fool. We use gifts for our charitable mission: encouragement, coaching, equipment and micro grants for working musicians in Colorado. Where a campaign or giving option describes a purpose, we use gifts made through it for that purpose as far as we can, and otherwise for the mission as our board directs.
Gifts are final. Gifts are not refundable. If you gave the wrong amount or gave twice by mistake, email us within 14 days and we will help.
Monthly gifts. A monthly gift charges your card each month, on the day of the month you started, until you cancel. Cancel any time from the Gifts page in the portal. Cancelling stops future charges and does not refund past ones. If a payment fails, our payment processor retries it and we email you; a gift whose payments keep failing stops until you update your card.
Thank-you gifts. Some giving options include something in return, such as a merch box. For those, your receipt states our good-faith estimate of the value of what you receive, because only the rest of your gift is tax-deductible.
Covering fees. At checkout you can add an amount that covers our payment processor's fees. It is optional, it is an estimate, and all of it goes to Holy Fool.
Receipts. We email a receipt for every gift and every ticket order, with the statements the IRS requires. Keep it for your tax records; we can resend one on request. Where a ticket includes a dinner or another benefit, the receipt shows the estimated value of that benefit and the deductible portion of what you paid.
3. Your portal and your responsibilities
You sign in with a link we email you or with the code on your ticket; there are no passwords. Keep your email account and your codes secure, because anyone who has them can act on your tickets. Give us accurate information, and tell us if your email address changes.
4. Payments
Stripe processes all card payments, under Stripe's own terms at stripe.com/legal and its privacy policy. You must be authorized to use the payment method you give us. If you have a problem with a charge, email us before contacting your card issuer; a dispute takes far longer to resolve for everyone. Payments by cash, check or other arrangement are subject to these same terms.
5. Email
When you buy a ticket, give, or join our mailing list, we email you the things you asked for, such as tickets, receipts and sign-in links. We may also email you about Holy Fool's events, campaigns and the musicians we support; every such email tells you how to unsubscribe.
6. Using the sites
You may use the sites only for their purpose: buying tickets, giving, and managing your tickets and gifts. Do not interfere with or overload them, probe them for weaknesses, use automated tools to buy tickets or collect data, impersonate anyone, or use a link or code that was not issued to you. We may block access and cancel tickets or orders obtained in breach of these terms.
7. Content
The text, images, names and logos on the sites belong to Holy Fool or to the artists and partners who let us use them. Music, images and other work by the musicians we feature remain theirs. You may use the sites' content for your personal, non-commercial purposes only.
8. Disclaimers and limits on liability
We run the sites with care, but we provide them as they are, without warranties of any kind, to the extent the law allows. We are not responsible for the venue, the performers or third-party services such as Stripe. To the fullest extent permitted by law, Holy Fool and its directors, staff and volunteers are not liable for indirect, incidental or consequential losses, and our total liability for any claim relating to the sites, a ticket or a gift is limited to the amount you paid for that ticket or gift. Nothing in these terms limits liability that cannot be limited by law.
9. Governing law
These terms are governed by the laws of the State of Colorado. Any dispute will be brought in the state or federal courts located in Denver, Colorado, and you and we agree to their jurisdiction.
10. Changes
We may update these terms; the date at the top shows the current version. Changes apply from the date they are posted and do not change the terms of a ticket you bought or a gift you made before then.
